Did you know that once you join, Uncle Sam might keep you there longer than you planned – or you could be back on active duty once you leave or retire?

As the name suggests, this extension depends on the service member. If you are serving in a designated assignment, location, or unit, you may voluntarily extend your enlistment beyond your normal end date.

If you do, you are entitled to a Special Assignment Incentive Pay (AIP) of up to $1,500 per month. The monthly payment, tickets, locations, specializations and limits vary depending on the service.

Unlike a voluntary extension, it happens whether a service member likes it or not. Under a program known as “stop loss,” it can keep you on active duty past your expected discharge date. This program has been around since 1984 and has been used several times.

Although not currently in effect, Stop-loss can be activated at any time. It usually requires Congress to declare an act of war or a national emergency. However, if Congress is not in session and the president decides it is in the national interest, he can declare a national emergency and keep any or all members on active duty for at least six months, or until Congress intervenes.

If you lost, the current rules require Uncle Sam to pay you an extra $500 each month for your trouble.

In most cases, not every service member will be lost. There are skill-based and unit-based stop-loss programs. This means that you may be involuntarily retained in the service if you have a certain important skill, or “for the sake of unit cohesion”.

Most people know that in some cases reservists and members of the National Guard can be called up for active duty and sent to war. What they may not know is that many service members remain in the reserves for several years after leaving active duty.

The minimum length of service anyone can join is eight years. If you read the fine print of your service contract, you may see that you serve on active duty for four years, and the Individual Ready Reserve (IRR) for another four years.

The IRR differs from the active or selected reserves because they are not required to be drilled and are not paid. The IRR remains as a supplement to the active forces during emergencies.

The rules vary, but in general any reservist can be returned to active duty for the duration of a declared war or national emergency, plus an additional six months. This declaration of emergency or war must be issued by Congress. If Congress is not in session, the president can use his power to recall them immediately.

Typically, the active duty reservist—those in the Guard and Reserve in drill status—are called first, then the IRR, then those who have left active duty within the last five years, then those under 60.

Absent an emergency, the president can recall up to 200,000 reserve troops for at least 400 days. When the nation is in a state of national emergency, the president can activate up to a million reserve troops at his command.

The United States has been in a state of national emergency since November 14, 1979, when Executive Order 12170 was issued by President Jimmy Carter 10 days after the Iran hostage crisis began. This order was continued by President Donald Trump in November 2017.

When it comes to the retention and return of retirees and officers, each service handles the situation in its own way.

For example, in the Navy, when an enlisted member retires after 20 years of active duty, he is transferred to the Navy Reserve. They remain in the Naval Reserve until they have a total of 30 years of service, then are transferred to retired roles. That is, if you are a Navy retiree who retired nine years ago, you may be returned to active duty if there is a reserve recall.

Other services do not have this condition. That is, if you retired as a recruit or as a non-commissioned officer from a service other than the Navy, your time is served and you will not be remembered.

Of course, everything is different for officers. When an officer retires, his commission usually remains in effect for good. In exchange for the right to be legally eligible to receive their rank and receive all of their retirement benefits, they essentially remain an “Officer of the United States” until they die. They can resign from their committee, but few do.

This means that if there is a recall, the officers can be reinstated without an act of Congress or a presidential recall.

Federal agencies can also transfer civilian employees with special skills in the event of war or a declaration of emergency. Typically, this will be backfilling of country support positions that have been transferred to theater operational roles.

Service members dismissed from the U.S. military for refusing Covid vaccines could be reinstated in uniform if the vaccine mandate is lifted, according to two U.S. Army and two senior defense officials.

On Tuesday, the House and Senate released language to be included in the National Defense Authorization Act that would require the Defense Department to remove the mandate. The NDAA, the annual bill that authorizes the military budget, must pass before the end of the year, and Democratic leaders are allowing Republicans to include the language to ensure its passage.

Pentagon leaders are discussing whether separated service members can rejoin if the NDAA is signed into law, the four officials said. They said requests to rejoin are likely to be handled on a case-by-case basis, but if service members leave under good circumstances — meaning they did not leave through discharges “other than an honorable discharge” — they may be allowed to re-enlist.

Defence Forces Members Kicked Out In Past 10 Years After Failing Drug Tests

Defense Secretary Lloyd Austin ordered in August 2021 that all members of the National Guard and Reserve Service on active duty be vaccinated against Covid or face separation. The language of the NDAA would direct Austin to rescind its provision. It is highly unusual for Congress to step in and overturn a legal standing order, the two senior defense officials said, noting that they could not immediately recall any precedent.

After Austin issued his mandate, thousands of active-duty service members were separated for refusing a Covid vaccine. (The members of the National Guard who refused to be vaccinated were
